An appellate judge in New York on Tuesday rejected a motion by former President Donald Trump to delay his criminal trial in the state while he appeals a “gag” order against him.
Trump, the presumptive Republican presidential nominee, has been indicted by Democratic District Attorney Alvin Bragg of New York County on 34 felony counts related to his alleged falsification of business records to conceal an alleged “hush money” payment to adult film actress Stormy Daniels. After being ordered by the trial judge to refrain from making certain statements about the case, known as a “gag” order, Trump on Monday, sought emergency relief from the New York Supreme Court Appellate Division to delay the trial while he appeals that order, with his request being denied by the court on Tuesday. “The application for an interim stay of the proceedings pending resolution of the Article 78 proceeding is denied,” wrote Associate Justice Cynthia Kern of the Appellate Division’s 1st Department, an appointee of Democratic Gov. Andrew Cuomo of New York. Trump may still petition the full bench of the 1st Department to rehear his motion.

“The First Amendment harms arising from this gag order right now are irreparable,” argued Trump’s attorney Emil Bove at the emergency hearing on Tuesday, according to the Associated Press. Lawyers for Bragg’s office, meanwhile, claimed that Trump’s statements about the case “[are] not political debate. These are insults.”
The gag order had previously barred Trump from commenting on the witnesses, jurors and other persons connected to the case. Trump’s trial in the case is set to begin with jury selection on April 15.
Trump’s campaign did not immediately respond to a request for comment.
